Any order placed by a buyer on the Online Shop is subject to these General Terms and Conditions of Sale to the exclusion of any other document, including the buyer's general terms of purchase.

Any clauses and conditions contrary to these General Terms and Conditions of Sale appearing on order forms and more generally on any type of correspondence from the buyer will be deemed null and void and will have no contractual value between the parties. These General Terms and Conditions of Sale may only be waived by the express written agreement of Château d'Osmond.

The products are described by the information on the technical data sheets.

The information provided on catalogs, brochures, advertisements, notices, or other documents of Château d'Osmond is for informational purposes only and does not bind Château d'Osmond, which may modify it at any time.

The photographs of the product sheets are for illustrative purposes only, and the product may differ from what is displayed.

Château d'Osmond reserves the right to correct any accidental material error or omission in these Terms and Conditions, as well as in any other contractual document.

ARTICLE 4: ORDER

Any order must be placed through the Online Shop by clicking on the "Order" button. The order is final only when the buyer has successively filled in all the mandatory information in the various sections and validated "Order with in-store payment".

The order is confirmed by Château d'Osmond by sending an email to the buyer.

Any order on the Online Shop implies the unreserved acceptance of these General Terms and Conditions of Sale, which the buyer acknowledges having read before placing the order.

The buyer undertakes to be at least eighteen years old at the time of the order.

In the event of non-compliance with these Terms and Conditions by the buyer, Château d'Osmond reserves the right to cancel all or part of the current orders or to suspend the delivery of goods.

ARTICLE 5: AVAILABILITY OF STOCK

The products are offered and delivered within the limits of available stock.

ARTICLE 6: VALIDITY OF THE ORDER

Château d'Osmond reserves the right to refuse any order for legitimate reasons and, in particular, in the event that the quantities ordered, by means of one or more orders, are abnormally high compared to the quantities usually ordered by buyers as consumers.

ARTICLE 7: PRICE

The buyer is obliged to pay the price at the time of collection in the shop.

The prices of the products are indicated in Euros including all taxes except for professionals with a specific account.

The invoiced prices of the products are those appearing on the Online Shop at the date of confirmation of the order by the buyer.

Château d'Osmond reserves the right to modify the applicable rates on the Online Shop at any time. The price change will automatically apply on the date of publication of the price modification on the Online Shop. In this case, the price charged will be that displayed at the time of the order.

All orders, regardless of their origin, are payable exclusively in Euros.

ARTICLE 8: PAYMENT

The buyer has the possibility to proceed with the payment of his order through different methods which are the following:

- online: by credit card (Visa, Mastercard, American Express) through the services offered by Crédit Agricole.

- online by check or bank transfer.

- at the Château: by check or credit card (Visa, Mastercard).

Château d'Osmond reserves the right to modify the available payment methods at any time.

ARTICLE 9: DELIVERIES

Orders are processed the day following their confirmation by the buyer on the site www.chateaudosmond.com (except Saturday and Sunday).

  • Pick-up at the Château by appointment.

The package is available for 10 working days following the receipt of the confirmation email and/or SMS. It is not necessary to travel before receiving these notices. Beyond this period, the order will be canceled.

  • Delivery by carrier

The delivery times are 3 to 5 working days (average observed times).

The package is delivered to the recipient upon presentation of an ID and signature on a digital terminal or delivery note.

ARTICLE 10: RIGHT OF WITHDRAWAL

In accordance with the Consumer Code (articles L221-18 to L221-23), the Customer may exercise a right of withdrawal for any online order.

This right may be exercised within 14 days following receipt of the last of the ordered products, as follows:

- Log in to your customer account

- In "Order history and details," select the relevant order and click on "Details"

- Select the products you wish to return

- Click on "Return a product"

This right may also be exercised before the shipment of the order.

Following withdrawal, the Customer undertakes to return the relevant products to Château d'Osmond within a maximum period of 14 days following the exercise of the right of withdrawal. The products must be shipped in perfect resale condition, in their original packaging.

Return shipping costs are the responsibility of the Customer.

Upon receipt of the withdrawal, Château d'Osmond will proceed, within a maximum period of 14 days, to refund the amounts received during the order, by credit to the account used during the card payment; subject to receipt of the relevant products.

ARTICLE 11: INTELLECTUAL PROPERTY RIGHTS

The site www.chateaudosmond.com and each of the elements that compose it (such as trademarks, domain names, texts, site structure, software, animations, images, photographs, illustrations, packaging, diagrams, logos, sounds, and music) are the exclusive property of Château d'Osmond or third parties who have duly authorized Château d'Osmond to exploit these elements, which is solely authorized to exploit the related intellectual property rights.

No element of the site may be used, reproduced, disseminated, or published in whole or in part without the prior written authorization of Château d'Osmond.

The use of all or part of the site www.chateaudosmond.com, notably by downloading, reproduction, transmission, representation, or distribution for purposes other than your personal and private use for non-commercial purposes is strictly prohibited.

The buyer's electronic identification data and cookies are retained for a period of 18 months from their collection or last update.

ARTICLE 19: APPLICABLE LAW - COMPETENT JURISDICTIONS

These general terms and conditions are exclusively governed by French law, to the exclusion of any other law, including the Vienna Convention of April 11, 1980, on the International Sale of Goods.
